Teacher Receives 35-Year Jail Term for Sodomizing a Student

The Garissa resident magistrate has sentenced Hussein Hassan Ali, a teacher and director of Mwangaza institutions, to 35 years in prison for sodomy.

The matter began in November 2021, when the victim, a student was transferred to a Malindi secondary school.

The magistrate found the defendant guilty of the crime, stating that he exploited his position and had a greater responsibility to protect the students he teaches.

“The accused abused his position to commit the offence. The victim has undergone psychological trauma and shame.”

The accused, through his attorney Omanya Cohen, argued that he deserved a non-custodial sentence for sustaining the community and paying teachers’ salaries.

The judge ruled, however, that this could not be used to subvert justice.

“The character of the accused should not go unpunished. Children need to be protected. Children need a good shepherd and not a wolf or hyena which easily feasts on lamps,” read part of his judgement.

The defendant was sentenced to 35 years in prison and has fourteen days to file an appeal.

The student of the victim commended the court for upholding the rule of law and urged the courts to continue handling cases involving children, rape, sodomy, defilement, and early marriages in accordance with the law.
