TSC Teacher Disciplinary Procedures; When Banned and Deregistered

Once a teacher is removed from the register, he or she is no longer permitted to teach in any school.

Through the Code of Regulations for Teachers (2015) and the Code of Conduct and Ethics (2015), TSC disciplines teachers.

The two sets of regulations stipulate teacher discipline procedures.

Not all educators subject to disciplinary action are dismissed. Those who are judged not guilty are reinstated immediately or after serving a suspension.

Teachers whose appeals are upheld by the Review Committee are reinstated and compensated for the time they were not paid.

“The employer can utilise internal disciplinary processes regardless of what’s going on in the criminal justice system, especially for sexual offences. This is professional misconduct,” says Cavin Anyuor, the TSC Legal, Labour and Industrial Relations chief.

According to the chief executive officer of the Commission, Nancy Macharia, investigations commence once a complaint is received.

A committee evaluates the complaint to determine whether an interdiction is warranted.

The case’s hearing comes last. Teachers who are placed under interdiction receive half their pay, but those who are placed under desertion are not affected.

They receive no compensation because their case is uncertain. Ms. Macharia stated that a disciplinary process can result in dismissal and removal from the register of instructors.

A teacher in this situation may appeal to the Review Committee or to a fair trial in court.

When an order is issued for a teacher’s reinstatement to the register, their names are reinstated in accordance with the directive, but not to employment.

After 18 months, a person whose name has been removed from the register of teachers may petition for reinstatement.
